    Loan modifications require mortgage broker license

    Only licensed mortgage brokers may provide home loan modifications in Colorado under the new Mortgage Broker Licensing Law, the Colorado Division of Real Estate reminded consumers on Wednesday.

    The reminder came because of the increased number of complaints the division has received about loan modification companies.

    "Any person offering to assist troubled borrowers by modifying the borrower's mortgage terms or conditions must be licensed as a mortgage broker in Colorado. Those operating without a license face steep fines and penalties for noncompliance," said Cary Whitaker, Mortgage Broker Program manager.

    The real estate division intends to step up investigations into loan-modification companies as consumers continue to complain about high fees and low results.

    These newly formed companies appear to have sprung up in response to the increased demand for solutions to the foreclosure crisis. "Borrowers need to be cautious before spending money on these services. Nonprofit HUD-approved housing counseling agencies are available to provide loan-modification assistance or foreclosure- prevention education, usually at no charge," said Erin Toll, director of the Colorado Division of Real Estate.     I don't do loan mods, and I will be the first to admit that I know little about them. That being said, I read something yesterday stating that if you want to do mods in California, you either need to be an attorney, or you have to have a specific license for loan mods as a company. The article stated that there are only 3 said companies in California. Seems, and again I'm stating this without much knowledge of mods, that people are plunging forward with mods like it were an unregulated, wide open free for all.

    I posted this for Brokers that do Mods in CO if there are any. I haven't done a Mod myself but agree with you that these companies are popping up everywhere.

    A specific license for loan mods?  Heck, we don't even have a separate license for mortgage brokers.  It's all lumped under a real estate license.  That is the license necessary to do loan mods in California.  If they are saying only three companies, that probably refers to how many company's have an approved Advanced Fee Agreement on file with the DRE.  I don't know if that is an actual number published by the DRE, but I bet that's what is being implied.  A licensed broker can do loan mods without the Agreement, they just can't collect any advanced fees.

    I'll see if I can provide a DRE link to confirm this as I am not claiming to be an expert.  I don't do loan mods.

    From the DRE website:

    Note: Licensed real estate brokers who provide loan modification or similar services without collecting fees in advance are not required to receive the Department of Real Estate’s permission as long as their services are fully completed before you pay them.

     

    Also, I see 21 brokers who have approved Advanced Fee agreements on file.  They are listed here: http://www.dre.ca.gov/mlb_adv_fees_list.html

    I know one of the agents, Francis Camacho, and based on my conversations with him, I would recommend him.
