    Sent Payment to Wrong Lender After Loan Sold
    My first mortgage payment was due 2/1, but my loan was sold on 1/15 to another company. I was notified 1/27, but had already sent the check to my original mortgage lender who said they would forward the payment to the new lender for my 3/1 due date. It wasn't forwarded and now my original company is telling me they have the right to the first payment, but my new mortgage company is telling me they don't. Please tell me who owns the first payment.

    Transfer/Sale of servicing of loans is covered under Sections 6 & 10 of RESPA. Lender #1 should have sent you a notice before the transfer, showing the effective date of the transfer, the date they (Lender #1) will stop accepting payments and the date the new servicer (Lender #2) will begin accepting them. During the 60-day period beginning on the effective date of the transfer, the payment may not be treated as late if you mistakenly send it to the old mortgage servicer instead of the new one. Write a letter to both requesting a payment history, and include a copy of your cancelled check for the 2/1 payment. This will protect you and allow both Lenders to rectify any mistakes made on the accounting/administration of your loan.
