    can i sue my lender if we feel they deliberately did not collect mortgage payments to force us into foreclosure

    I don't know much about your situation.  I will assume that you got behind and tried to make a payment and they would only accept ALL payments that were past due and sent your payment back to you.  This happens all the time.  You need to contact an attorney and find out your rights to keep your home if you are now able to make payments each and every month.
