Q: I think my spouse took a second mortgage on our home without telling me about it. How can I find out if he did or didn't?
  • That would be difficult for him to do, but not impossible.  You have a couple of options here.

A mortgage would be recorded in your county court house.  This is completely accessible to anyone from the general public to see if they know where to look.  You could go to your county courthouse and attempt to search for recorded liens against the home.  Should you have a helpful clerk you may be able to accomplish this.

A simpler solution may be to look up title insurance or settlement agent in your local phone book.  For a nominal fee they can have a professional searcher find all liens recorded against the property.
