The answer to that is no...if the person staying in the home is making payments on time there is no reason that they should force them out of the home. The best bet in this situation is to have the person staying in the home to re-finance the mortgage into there name only at that time. Calling a reputable broker would be a good idea at this time and have them look into the re-finance for you. In the above Directory link you should be able to find a Loan Officer in your state to work with, they should be able to help the person staying in the home find the right loan program for the re-finance.
I do agree with Jill that finding a siold broker is critical. In addition to that you may want to contacta attorney about any issue's of equity or financial responsiblity. Depending on the state you may live in, a attorney state would require you to contact a attorney in regards to a mortgage transaction. But to force one out would be difficult at best. My best suggestion would be to see if there is a mutual ground you can find and move forward from there. Wish you the best.
