    Loss Mitigation Attorneys

    I'm an attorney in CA.  I need to obtain a copy of my client's loan docs and all related docs from their lender.  I'm going to use a Qualified Written Request pursuant to RESPA, however, based upon my reading of the applicable section I'm not convinced this section is completely applicable.  Has anyone had any luck with this or other methods of obtaining documents from lenders/servicers?

    If you're an attorney just issue a demand letter.  You can also quote TILA in your QWR as well as any California regs that may apply.  Make sure that you say you suspect deceptive practices, fraud and/or predatory lending in your QWR or they will just send you a payment history with a copy of the mortgage and note.

    I have actually been having tremendous sucess with my QWR in obtaining loan documents from lenders.  Thanks for your advise.
